Zambrero is committed to protecting your privacy, and respects and upholds your rights to privacy protection under applicable privacy laws. These laws regulate how we collect, hold, use and disclose personal information (as defined in those laws) about you and other individuals.

In New Zealand, Zambrero complies with the Privacy Principles and the other requirements of the Privacy Act 1993.

2. Privacy Officer

In accordance with the requirements of the Privacy Act 1993, Zambrero has appointed a Privacy Officier known as the "Zambrero Group Privacy Officer". The Zambrero Group Privacy Officer has statutory obligations to:

  • encourage and ensure Zambrero's compliance with the Privacy Principles;
  • deal with requests made to Zambrero for access to and/or correction of personal information; and
  • work with the Privacy Commissioner on any investigation into Zambrero.

3. What is your personal information?

Personal information means information about an identifiable individual. This may include your name, address, telephone number, email address and profession or occupation. If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.

4. What personal information is collected from you?

Examples of personal information which we may collect from you include, but are not limited to, your name, postal address, delivery and collection addresses, fax, phone number, NZBN and e-mail address. This personal information may also include details of the products which you have purchased from Zambrero, such as the date that you purchased the product and the type of product purchased. If you provide financial information to us, or establish a credit account with us to pay the fees we charge, we collect some additional necessary information, such as a billing address, a credit card number and credit card expiration date, financial institution account details and tracking information from cheques or money orders.

5. How we collect your personal information

Zambrero will collect information directly from you. From time to time information will be collected on our behalf by our franchisees. We collect personal information about individuals in a number of ways, including:


  • directly from you when you make a telephone enquiry or place an order for a product over the telephone;
  • directly from you if you send us personal correspondence, such as emails or letters;
  • when you provide information through our Website;
  • when you complete Zambrero’s subscription forms;
  • when you enter competitions/promotions run by us;
  • from third parties such as from credit reporting bodies;
  • from Zambrero related companies;
  • from publicly available sources of information;
  • from third parties, where it is reasonably necessary or normal business practice, so that we can continue to provide you with our products; and
  • from our own records of how you use our products.

Zambrero uses your personal information so that we can improve and perform our business activities and functions, and to provide you with any products which you may request, or to respond to any query or complaint that you may have. We may also use your personal information to:

  • provide the products you require for which you specifically provided the personal information (for example, to respond to a specific inquiry or to charge your credit card for a purchased product) or for related purposes that would reasonably be expected;

Zambrero may combine any information which it collects from you with information collected by its related companies in Australia and New Zealand. We will not sell or license any of your personal data to third parties for their direct marketing purposes unless we have your express consent to do so.

7. What happens if we cannot collect your personal information?

If you do not provide us with the personal information described above, some or all of the following may happen:

  • we may not be able to provide our products to you, either to the same standard or at all;
  • we may not be able to provide you with information about products which you may want, including information about special promotions;
  • we may be unable to tailor the content of our Websites to your preferences, and your experience of our Websites may not be as enjoyable or useful; or
  • we may not be able to contact you regarding Zambrero promotions which you enter.

8. When we disclose your personal information

In order to deliver the products you require, Zambrero may disclose your personal information to organisations outside Zambrero. Your personal information may be disclosed to these organisations so that we can provide you with the required services or conduct the necessary administrative or marketing function required. These organisations include, but are not limited to, organisations and third party service providers which carry out services on our behalf, including our: customer enquiries;

(In these instances, unless otherwise disclosed to the entrant prior to, or at the time of, entering the competition/promotion as normally set out in the competition's or promotion’s terms and conditions any personal information collected about an entrant will be returned to Zambrero).

Zambrero endeavours to take reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

9. Transfer of personal information outside New Zealand

Your personal information may be shared between Zambrero entities located in Australia and New Zealand. For personal information that we collect in New Zealand, we take all reasonable steps to ensure that the personal information which has been transferred outside of New Zealand will not be held, used or disclosed by the recipient of the information inconsistently with the Privacy Principles or the privacy laws applicable in Australia that provide a comparable level of protection. In addition to holding your personal information in New Zealand we may hold your personal information outside New Zealand. We may also disclose your personal information to entities located outside of New Zealand. These include:

  • holding your information in our data hosting and other IT facilities; and

10. Direct Marketing and your privacy

Zambrero also collects your personal information for marketing purposes, including e-newsletters, promotions and special offers. Our communications may be sent to you in various forms, including mail, SMS, fax and email, in accordance with applicable laws. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

If you have received marketing information from Zambrero and you wish to stop receiving it, you can contact us (either using the contact details below or the opt-out mechanism detailed in our marketing material), and ask us to stop sending the marketing information. Zambrero will not charge you, or in any way disadvantage you, if you choose to opt out of receiving marketing material.

To protect your privacy, Zambrero may require proof of your identity before acting upon your request. Access will be provided unless there is a legal or administrative reason for denying or limiting access, as permitted by the Privacy Act 1993, in which case we will let you know the reason for denial of access.

Zambrero will take reasonable steps to ensure the personal information held by us is accurate, up to date, complete, relevant and is not misleading. Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example, by mailing or emailing it to you). 14. How do you make a complaint?

If you wish to make a complaint to Zambrero about a possible breach of privacy, please provide full details of your complaint in writing, and send it to the Zambrero Privacy Officer (see contact details above).

If your complaint does not relate to these matters, you must first lodge a complaint with us in writing and provide us with details of the incident so that we can investigate.
